CQC v NHS Trust

Acted for an NHS trust in a prosecution by the CQC for failure to provide safe care and treatment, which exposed service users with limited capacity to a significant risk of avoidable harm. The prosecution arose from the death of a service user with dementia, who suffered a fatal fall after leaving their ward.
